• Any other liability that cannot lawfully be excluded or limited.

Linked Travel Arrangement (LTA) Notice

Where applicable, your booking may constitute a Linked Travel Arrangement under the Package Travel and Linked Travel Arrangements Regulations 2018.

By proceeding with such a booking, you acknowledge and agree that:

• Travel services, including but not limited to flights, accommodation, transport, visa assistance and other travel services, may be purchased as separate components and may not constitute a package holiday.
• A separate contract may be formed between you and each individual service provider, including an airline, hotel, transport operator, visa service provider or other supplier.
• MashaAllahTrips acts as an intermediary in facilitating these arrangements and, subject to your statutory rights, is not responsible for the proper performance or failure of services provided by third-party suppliers.
• In the event of a cancellation, delay, disruption, amendment or other change, including airline cancellations, supplier changes, force majeure events, government restrictions or operational issues, the individual terms and conditions of the relevant supplier will apply.
• Any refund will be subject to the relevant supplier’s cancellation policy, eligibility criteria and processing times.
• Refunds are not guaranteed unless expressly confirmed in writing.
• Unless otherwise expressly stated in writing, bookings, deposits and other payments may be non-refundable and non-transferable.

Where required by applicable law, insolvency protection will apply to eligible payments received by us for travel services forming part of a Linked Travel Arrangement that are not performed because of our insolvency.

Such insolvency protection does not extend to the performance, failure or insolvency of an individual third-party supplier where the relevant service can still be performed or where payment was made directly to that supplier.

The protections that apply to package holidays may not apply to a Linked Travel Arrangement. Each individual service provider remains responsible for the proper performance of the service provided under its separate contract with you.

We strongly recommend that you obtain comprehensive travel insurance at the time of booking. Your insurance should provide suitable cover for cancellations, medical expenses, delays, missed departures, baggage loss, supplier failure and other unforeseen circumstances.

Third-Party Supplier Liability

To the fullest extent permitted by law and subject to your statutory rights, MashaAllahTrips shall not be liable for any loss, cancellation, delay, disruption, additional expense or inconvenience arising from the acts, omissions, insolvency or failure of a third-party supplier.

Third-party suppliers include, but are not limited to:

• Airlines.
• Hotels and accommodation providers.
• Transport operators.
• Visa service providers.
• Tour operators.
• Ground-handling agents.
• Other travel service providers.

Any complaint or claim relating to the performance of an individual travel service should initially be directed to the relevant service provider.

Where reasonably possible, we may assist you in communicating with the supplier. Any such assistance does not constitute an acceptance of liability by MashaAllahTrips.

Severability

If any provision of these Terms of Use is found by a court, tribunal or other authority of competent jurisdiction to be invalid, unlawful or unenforceable, that provision shall be modified or severed to the minimum extent necessary.

The remaining provisions shall continue in full force and effect.

Where possible, an invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects its original commercial and legal intent.

The invalidity or unenforceability of any provision in one jurisdiction shall not affect the validity or enforceability of that provision in another jurisdiction.

Entire Agreement

These Terms of Use supersede all prior agreements, arrangements, representations and statements between you and us relating to your use of this website, except where liability for such statements cannot lawfully be excluded.
